Regulation of motor third-party liability insurance

The advent of autonomous vehicles raises many new questions regarding vehicle operation and liability insurance for such a vehicle. The vehicle insurer should have the right to obtain vehicle operation data from the recording device. This is essential for investigating claims. Autonomous vehicles naturally bring about many changes in liability insurance. Only future developments will show the extent to which information can be obtained from vehicle manufacturers and how legal regulations concerning liability for damages caused by the operation of vehicles they produce will evolve.

Another new feature is the insurer's right of recourse against the repairer if an accident occurred during the car's repair. This should prompt the car service or specific mechanic to arrange operational liability insurance, as they are considered the operator of the vehicle during the repair.

All of this should now be aided by digitalization, which facilitates the transfer and speed of data exchange between the insured, the insurance intermediary, the insurance company, and the road vehicle register. The new proposal also addresses the use of data from the Ministry of Transport's road vehicle register for liability insurance purposes. According to the proposal, the data in the register should be considered current and valid. The proposal also aims to prevent errors in the technical data of vehicles subject to mandatory liability insurance by allowing insurers to obtain relevant data directly from the Czech Insurers' Bureau (ČKP) based on their authorization.

The new draft law also regulates the status of the ČKP, anticipating the abolition of its position as an insurance company. Given the ČKP's status, the new directive aims to designate the ČKP as a non-profit organization. These changes will also require a new accounting method, which will align with the Accounting Act. Until then, the ČKP will still be regarded as an insurance company from an accounting perspective.
